Wellbee Social Inc. - Terms of Service

Welcome to Wellbee Social, a community-driven platform fostering natural and holistic wellness. These Terms of Service (“Terms”) govern your use of the Wellbee Social website and services, including purchasing courses, event tickets, and products or becoming an Instructor. By accessing the platform, you agree to these Terms, our Privacy Policy and our Instructor Terms (if applicable).
If you do not agree with these Terms, please do not access or use our services.
Wellbee Social Inc. (“Wellbee,” “we,” “us,” or “our”), an Alberta-based corporation, operates this platform.
1. Overview of Services
Wellbee Social provides the following features:
- Courses: Purchase and participate in courses created by Instructors.
- Events: Browse and purchase tickets for Instructor-hosted events.
- Products (coming soon): Buy physical and digital products from Instructor storefronts.
- Community Features: Create profiles, join groups, add blogs, and engage in wellness discussions by posting web links, media, images, documents and/or opinions.
- AI Tools: Wellbee AI tools to assist Instructors in creating courses, marketing products, and event descriptions.
- Unlimited Wellbee AI: Optional upgrade for Unlimited Access to Wellbee AI Assistance.
2. Definitions
For the purposes of these Terms:
- “User” refers to any individual or entity using Wellbee Social’s Services.
- “Content” refers to text, images, video, audio, or other material on the Wellbee Social Platform.
- “Service” refers to Wellbee Social’s platform, including its website, subdomains, and tools such as Wellbee AI.
- “Wellbee AI” refers to Wellbee Social’s artificial intelligence tool designed to assist Instructors with course creation, event marketing, product descriptions, and related tasks.
- “Company” refers to Wellbee Social Inc., headquartered in Alberta, Canada.
- “Submitted Content” refers to text, images, videos, audio, blogs, group creations, event descriptions, courses and lessons, product images and description, uploaded by Users.
- “Enthusiast” refers to any individual who has created an account on Wellbee Social and self-identifies as an ‘Enthusiast’ at the time of registration and on their profile page.
- “Professional” refers to any individual who has created an account on Wellbee Social and self-identifies as a ‘Professional’ in a holistic and wellness field.
- “Instructor” refers to anyone who self-identifies as Professional on their profile page and during registration, and who has received an approval after submitting the Instructor Application form.
3. User Roles and Responsibilities
3.1 Enthusiasts:
- Enthusiasts are registered users who participate in community activities such as joining groups, posting content, and purchasing courses, event tickets, and products.
- Enthusiasts cannot sell courses, event tickets, or products on the platform.
3.2 Professionals:
- Self-identified Professionals: Professionals are users who self-identify as having qualifications, credentials, or experience in a specific field. They can participate in community activities and publish content but cannot sell courses, event tickets, or products on the platform unless approved as Instructors after submitting an Instructor Application Form.
- Instructors: Professionals who have applied and been approved to receive an Instructor Badge. Instructors may sell courses, events, and products (coming soon).
3.3 Instructors:
- Instructors are Verified Professionals who have been granted Instructor Badges after completing the application and approval process.
- Instructors must abide by the additional Instructor Terms.
- Instructor status may be revoked at any time, for any reason or no reason, at Wellbee Social’s sole discretion.
4. Thematic Focus
4.1 Approved Themes:
Core themes include:- Homeopathy, Naturopathy, Ayurveda, Reiki, Nutrition, Fitness, Yoga, Meditation, Herbal Medicine, Aromatherapy, Crystal Therapies, Mental and Emotional Wellness, Bach Flowers, and Sound Healing.
4.2 Proposing New Themes:
Content in unlisted themes requires approval from the Wellbee Social Admin Team.4.3 Content Moderation:
Wellbee Social reserves the right to remove content that violates these Terms or misaligns with our thematic focus.5. Wellbee AI
5.1 Wellbee AI for Instructors
Wellbee AI is a tool available to Instructors. The free version is given with limited usage capability. Instructors can use Wellbee AI for assistance in:
- Course creation and outlines.
- Event marketing descriptions.
- Product descriptions and promotional content (coming soon!)
Optional Subscription for Unlimited Wellbee AI Access. Terms include:
- Monthly Billing: Fees are billed monthly in advance.
- Cancellation Policy: Instructors may cancel at any time. Cancellations take effect at the end of the current billing cycle.
- No Refunds: Subscription fees are non-refundable, even if the Instructor discontinues using Wellbee AI before the end of the billing cycle.
5.2 Limitation of Liability for Wellbee AI
- Accuracy and Reliability: Wellbee AI outputs are suggestions based on input provided by Instructors. Wellbee Social does not guarantee their accuracy, reliability, or completeness.
- User Responsibility: Wellbee AI is provided “as is” and may not be error-free. Users are responsible for verifying and ensuring compliance of AI-generated content. Wellbee Social is not liable for outcomes from using Wellbee AI.
- Modification and Termination: Wellbee Social reserves the right to modify, suspend, or discontinue Wellbee AI at any time without notice. No refunds will be provided.
- Third-Party Services: Wellbee AI may rely on third-party services, and Wellbee Social is not responsible for any data breaches or issues arising from these integrations.
By subscribing to Wellbee AI, you agree to these terms.
6. Purchases and Transactions From Instructors
- Instructor Policies: Instructors set policies for shipping, cancellations, returns, and refunds. Users must review these policies before purchasing.
- Wellbee Social’s Role: We act as a platform provider and are not liable for disputes, quality issues, or delivery failures, including, but not limited to: non-delivery, defective products, or discrepancies in course, product, or event descriptions.
- Purchases: Users must be logged in or create an account to purchase courses, events, or products. Account creation or logging in allows users to communicate with Instructors and/or Event Organizers.
- Transaction Fees: Instructors are subject to platform fees, as outlined in the InstructorInstructor Terms.
- Currency: All transactions are processed in Canadian dollars (CAD).
7. Refunds and Cancellations from Instructors
7.1 Courses
Refunds for courses are subject to the following conditions:
- Users may request refunds within 7 days of purchase, provided no more than 10% of the course has been viewed or completed.
- Refund requests are reviewed on a case-by-case basis.
- Instructors will not receive revenue for refunded courses.
7.2 Events
Refunds for events follow these guidelines:
- Users may request refunds if the event is canceled or rescheduled.
- Instructors must disclose their refund policies on event descriptions.
- Instructors will receive Event Payouts after the completed scheduled Event to allow for refund processing.
7.3 Products – coming soon
Refunds for physical or digital products are subject to Instructor policies, which must be clearly stated on their storefront. Instructors must outline:
- Shipping policies.
- Return, exchange, and refund terms.
- Maximum refund timeframe, not exceeding 20 days.
Instructors retain responsibility for managing refunds directly with Users. Wellbee Social facilitates transactions but is not liable for refund disputes.
8. User Responsibilities
8.1 General Responsibilities:
Users must:
- Provide accurate and complete information.
- Maintain the security of their accounts.
- Ensure uploaded content complies with laws and regulations.
Users must not:
- Share offensive, discriminatory, or illegal content.
- Impersonate others or misrepresent affiliations.
- Exploit vulnerabilities or compromise platform security.
8.2 Community Standards:
Users are expected to:
- Report inappropriate content or behavior.
- Respect others’ opinions, identities, and contributions.
- Avoid posting offensive, harmful, or discriminatory content.
- Report violations to Wellbee Social promptly.
9. Prohibited Activities
Users must not:
- Share harmful or inappropriate content.
- Introduce malicious software.
- Engage in unlawful activities or violate any applicable laws.
- Upload content infringing intellectual property rights.
- Use the platform for spam, phishing, or other malicious purposes.
- Impersonate others or misrepresent affiliations.
- Introduce harmful software or interfere with the platform’s functionality.
10. Intellectual Property
- User Content: Users retain ownership of their content but grant Wellbee Social a license to use it within the platform, and outside the platform for marketing and promotional materials. All ‘Submitted Content’ can be used by Wellbee Social to help promote the platform, this includes, but not limited to: snippets of course content, lessons, member profiles, posts, blogs, media, and other related content.
- Wellbee Content: Logos, designs, and platform elements are the intellectual property of Wellbee Social.
11. Instructor Specific Terms
Instructors are bound by the Instructor Terms, which govern their use of the platform to sell courses, events, and products.
Key highlights:
- Instructors must adhere to their own stated policies for shipping, returns, and refunds for products.
- Instructors are recommended to adhere to Wellbee Social’s return and refund policies for courses and events as stipulated in Sections in 7.1 and 7.2
- Instructors are responsible for accurate product descriptions, event details, and course content.
- Wellbee Social is not liable for transactions between Instructors and Users.
12. Limitation of Liability
To the extent permitted by law, Wellbee Social is not liable for:
- Loss of data, revenue, profits, or business opportunities.
- Indirect, special, or consequential damages.
- Issues arising from third-party integrations or payment processors (e.g., PayPal).
Wellbee Social Inc. shall not be liable for indirect, incidental, or consequential damages. Direct damages are limited to the amount paid by you to Wellbee Social in the six months preceding the claim.
13. Termination and Account Deletion
- Wellbee Social reserves the right to terminate or suspend accounts for violations of these Terms or other policies.
- Users may request account deletion by contacting support.
- Submitted Content may remain on the platform even after an account has been deleted (e.g., courses and lessons that offer lifetime access).
- If Instructors request an account deletion, Wellbee Social admin team will conduct a review that all products and services promised to buyers have been delivered before the account can be deleted. Instructors requesting deletion must ensure all commitments to purchasers are fulfilled.
14. Updating These Terms
Wellbee Social may update these Terms periodically. Changes will be communicated via email or platform notifications. Continued use of the platform after updates constitutes acceptance of the revised Terms.
